1. General Provisions
1.1. These rules of the online store (hereinafter – the Rules) constitute a legally binding document between the Buyer and the Seller (hereinafter – the Seller), setting out the rights and obligations of both Parties.
1.2. The Seller reserves the right to amend, revise, or supplement these Rules at any time. The Buyer will be informed of any changes to the Rules on the online store’s website.
2. Conclusion of the Purchase-Sale Agreement
2.1. The purchase-sale agreement between the Buyer and the Seller is deemed concluded when the Buyer, having familiarized themselves with these Rules, forms and submits an order for goods in the online store.
3. Rights of the Seller
3.1. In the event of important circumstances, the Seller may temporarily or completely suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the online store, or fails to fulfill their obligations, the Seller has the right, without prior notice, to restrict or suspend the Buyer’s access to the online store.
4. Obligations of the Seller
4.1. The Seller undertakes to provide access to the online store services under the conditions set out in these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer in the delivery method chosen by the Buyer, in accordance with the conditions established in these Rules.
4.3. If, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the purchase-sale agreement after informing the Buyer. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the money paid within 3 business days.
4.4. If the Buyer exercises the right set out in Clause 5.2, the Seller undertakes to refund the money paid within 5 (five) business days from the date of receipt of the returned product.
4.5. The Seller may withhold the refund until the goods are returned to the Seller or until the Buyer provides proof that the goods have been dispatched back to the Seller, whichever occurs first.
5. Rights of the Buyer
5.1. The Buyer has the right to purchase goods from the online store in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the purchase-sale agreement concluded in the online store by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The right referred to in Clause 5.2 may only be exercised if the product has not been damaged, has not substantially changed its appearance, and has not been used.
6. Obligations of the Buyer
6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure established by these Rules.
6.2. If, without valid reasons, the Buyer refuses to accept the goods at the time of delivery, the Buyer must, at the Seller’s request, cover the costs of returning the goods.
6.3. At the time of delivery, the Buyer must inspect the condition of the parcel and the goods together with the Seller or the courier who delivered the shipment.
6.4. By using the online store, the Buyer confirms that they agree with these purchase-sale Rules and undertake to comply with them.
7. Prices of Goods
7.1. Prices of goods in the online store are indicated in euros. Prices include VAT. Upon confirming the order, the total price of goods may include a delivery fee, if applicable.
8. Ordering and Payment
8.1. When visiting the online store, the Buyer selects the desired goods and adds them to the shopping cart. After forming the cart, the Buyer enters personal data necessary for fulfilling the order: name, surname, delivery address, phone number, and any additional information relevant to delivery. The Buyer confirms that they have read these Rules and places the order.
8.3. Payments can be made via Swedbank, SEB, Luminor, Citadele, Šiaulių bankas electronic banking services, Visa/MasterCard payment cards, PayPal, Apple Pay, and Google Pay. Payments are made in euros and are processed via www.makecommerce.lt, www.paypal.com, and www.shopify.com payment platforms.
9. Delivery of Goods
9.1. When placing an order, the Buyer must provide the exact delivery address.
9.2. The Buyer must personally accept the goods. If the Buyer cannot accept the goods but the goods are delivered to the address provided, the Buyer has no right to make claims regarding delivery to the wrong person.
9.3. The Seller delivers the goods to the Buyer according to the terms indicated in the product descriptions.
9.4. All features of the goods are specified in the description attached to each product. The Seller is not liable if the colors, shapes, or other parameters of the goods in the online store do not match the actual size, shape, or color of the goods due to the specifications of the Buyer’s monitor.
9.5. If the Buyer withdraws from the purchase-sale agreement, all amounts paid by the Buyer, including delivery costs, will be refunded.
10. Returns of Goods
10.1. Quality goods may be returned within 14 days from the date of receipt. Defects of defective goods will be remedied, defective goods will be replaced or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be met:
10.2.1. The returned goods must be in their original undamaged packaging (this does not apply if the goods are defective);
10.2.2. The goods must not be damaged by the Buyer;
10.2.3. The goods must not have been used and must retain their commercial appearance: labels intact, protective films not removed, etc. (this does not apply if the goods are defective);
10.2.4. The goods must be of the same set as received by the Buyer (this does not apply if the goods are defective);
10.2.5. The Seller has the right to refuse the return if the return conditions have not been met;
10.2.6. Goods must be returned in the manner specified by the Seller within 14 (fourteen) days from the date of receipt (this does not apply to defective goods – defective goods are returned within the statutory warranty period).
10.3. The return and exchange of quality goods shall be carried out in accordance with Article 6.228(10) of the Civil Code of the Republic of Lithuania.
10.4. For goods accepted by the Buyer but later returned, the money will be refunded to the Buyer’s account no later than within 5 (five) days from the date of return, unless the Buyer and the Seller agree otherwise.
11. Final Provisions
11.1. These Rules are drawn up in accordance with the laws of the Republic of Lithuania.
11.2. These Rules and the relations arising between the Parties shall be governed and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disputes arising from the implementation of these Rules shall be settled by negotiation. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
11.4. The Parties are released from their obligations under these Rules if their performance is prevented by unforeseen circumstances beyond the control of the Parties (Force Majeure).
